Patents

                We obtain patent protection on inventions for clients ranging from individuals and start-up companies to large, multinational corporations.  In all the matters we handle, our focus remains the same: understand the client's technology and the business objectives surrounding the patent prosecution efforts.  This focused approach ensures maximum patent quality as demonstrated by the multiple patents we have prosecuted that have been successfully enforced in U.S. District Court litigation.

                In addition to patent procurement, we represent clients in all post-grant proceedings offered by the United States Patent and Trademark Office including reissue, reexamination, and the upcoming post-grant review and inter partes review proceedings. 

Patent  Litigation

                We serve as lead counsel  in patent disputes throughout the United States.  We have litigated patent cases in such diverse jurisdictions as Delaware, Pennsylvania, New Jersey, Virginia, Texas, California, Florida, and Michigan. These litigations involved a wide-spectrum of technologies including consumer electronics, lithium ion batteries,  biotechnology,  specialty chemicals,  and pharmaceuticals. We constantly strive to understand the business issues underlying the dispute, and work diligently to meet our client's objectives in a cost-effective manner.

Intellectual Property Counseling 

              We provide a wide variety of intellectual property counseling services to our clients. We understand the importance of providing clear, understandable advice that our clients can rely upon in making business decisions regarding intellectual property.   Our services cover all areas of IP strategy and risk management including both offensive and defensive scenarios (including freedom to operate studies and clearance opinions).


Trademarks

                We provide a full range of trademark services to our clients.  This includes counseling regarding selection and clearance of a mark; prosecuting trademark applications; advising on trademark use and maintenance; and enforcement of trademark rights.  We also work with clients on trademark licensing and co-existence agreements.

                When trademark disputes arise, we work with our clients to resolve them in a cost effective manner while meeting their business objectives.  We litigate trademark issues on behalf of our clients in opposition/cancellation proceedings in the United States Patent and Trademark office.  We also litigate trademark infringement issues in district court litigation including actions involving counterfeit goods.  Regardless of the setting, our focus remains the same:  providing first-rate representation to our clients.


Copyrights

                We provide a full range of copyright services to our clients including preparing and filing applications to register copyrights, licensing copyrighted materials, and enforcing copyrights against infringers via litigation.

                We represent the full range of copyright registrants including artists, authors, musicians, and businesses.

Software Protection

                We work with our clients to obtain copyright protection in their software.  We assist with a wide variety of software licensing issues including structuring employment, development, and consulting agreements to ensure that our clients maximize their rights in their software.


Internet Issues

                We represent clients with regard to a variety of intellectual property issues involving the internet.  These include copyright infringement issues, sending and responding to "take-down" letters, and domain name disputes.


Designs

                We represent clients on all facets of design protection including design patents, trade dress, copyright, and trademark.


Transactions

                We handle all aspects of intellectual property transactions including due diligence, contract negotiation, technology transfers, joint ventures, joint development, co-marketing and co-branding arrangements, and licensing transactions (both in-licensing and out-licensing of intellectual property).  In all cases, we strive to understand our client's business objectives in a particular transaction.


Business Disputes

                We handle State and Federal court litigation involving commercial disputes (e.g., breach of contract, breach of indemnification obligation) and business tort claims (e.g., fraud, unfair competition, breach of covenant not to compete).  We also represent our clients in arbitrations of business disputes.


Delaware Local Counsel Services

                We are frequently called upon to act as Delaware or local counsel for out-of-state attorneys and businesses  involved in litigation before Delaware Courts, including patent litigation, Chancery Court actions, and State Court actions.  We have extensive experience before the Judges in these Courts and the  Magistrate Judges that handle mediations.

                In addition to pure local counsel arrangements, we frequently partner with other firms to act as co-counsel in a variety of Court disputes, especially those involving intellectual property.
